Hello and welcome to Pogo (“Pogo”, “Us,” “We,” “Our”), a mobile device application (“App”) and website located at www.pogorides.com (collectively, the “Service” or “Services”). Protecting Your privacy is important to Us, so We’re providing this Privacy Statement to explain Our practices regarding the collection, use, and disclosure of information that We receive when You use Our Services.

This Privacy Policy was last revised on September 1, 2016. By using the Site and/or the Services, You consent to Our collection, storage, use and disclosure of Your personal information and other information as described in this Privacy Policy.

1. Other Terms Used in This Policy

In the course of this Statement We will refer often to people who use Our Services to engage in local transportation services via Ride Offers or Ride Requests (collectively, “Rides”) as Drivers, Ride Requestors or Minor Passengers (collectively, “Users”). Drivers will be parents or guardians or others (such as nannies, aunts, or grandparents) providing Rides through their Groups. Ride Requestors are parents or guardians who request Rides on behalf of minors for whom the Ride Requestor has the legal authority to coordinate Rides (“Minor Passengers”).  Other capitalized terms have the same meaning as in Our Terms of Service or as defined in this Policy.

2. Changes to Our Privacy Policy

Pogo reserves the right to change this policy and Our Terms of Service at any time. If at any point We decide to use Personal Information (as defined below) in a manner materially different from that stated at the time it was collected, We will notify Users by way of an email or by providing 30 days’ notice on the Pogo Site and App. Non-material changes or clarifications will take effect immediately upon posting of the updated policy on Our Site. You should periodically check www.pogorides.com/privacy and www.pogorides.com/terms for updates. Your use of the Site or the Services after such effective date will constitute acceptance by You of such changes.  By using the Services, You agree to all terms set forth by Pogo in both its Privacy Policy and Terms of Service and any other policies published by Pogo on the Site or App. If You do not understand Pogo’s policies, please contact Us at support@pogorides.com.

3. Information We Collect

We collect both “Personal Information” and “Non Personal Information” about Our Users. In this policy, “Personal Information” is information that can be used to contact or identify You, such as Your full name and email address, and information that is linked to such information. “Non Personal Information” is information that cannot be used to contact or identify You and is not linked to information that can be used to contact or identify You and includes passively collected information about Your activities on Our Site, such as usage data, to the extent that information is not linked to Your Personal Information.

Visitors to the Site and users of the App can access and browse certain portions of the Site and App without disclosing Personal Information, although, like most Services, We passively collect certain information from Your computer and/or device, such as Your IP address and web browser, when You browse the Site or App. Visitors who access and browse the Site or download the App without registering are “Site Visitors.” In order to utilize some of the Services offered by Pogo, You must register with Pogo, either through the Site or App.  All users who register with Pogo are “Registered Users.”

a. Information You provide

Regardless of whether You are a Site Visitor or a Registered User, all Personal Information that You provide to Us when registering, creating or modifying Your account or profile, posting a Ride Offer or Ride Request, communicating through the Services, utilizing Our App, or that You otherwise provide on the Services or by phone, email or postal mail, will be stored by us. You represent and warrant to Us that You have the right and authority to provide Us all Personal Information You provide about Yourself or others. You may provide Us this Personal Information in various ways, including:

i. When registering and/or posting a profile

When You register with Pogo, We will collect and store the information that You provide to Us about Yourself and Your Minor Passengers directly on Our electronic registration forms. This may include, among other information:

        1. first and last name
        2. email address
        3. postal address
        4. grade in school
        5. mobile phone number
        6. optional statement about yourself that appears in your profile
        7. special instructions for Minor Passengers
        8. profile picture and other pictures You may upload to Your profile during registration, such as pictures of Minor Passengers
        9. groups in which You are a member.

Some users may have the opportunity to log in to Pogo by connecting through Facebook’s application programming interface (API). Please see Section 1) b) iii) below to learn about the information We access, collect and store if You log in to Pogo through Facebook.

ii. When posting a Ride Request

If You are a Ride Requestor, We collect and store all of the information that You provide in Your Ride Request. This may include, among other information:

        1. the desired pick-up and drop-off locations;
        2. the desired pick-up and drop-off times;
        3. information about Passengers, including Minor Passengers, such as first name, last name, phone number (if the Ride Requestor consents to Drivers being able to communicate with Passengers through text messages and/or voice calls regarding a Ride), photos of Passengers, list of parents/guardians and their contact information;
        4. information about the Ride Requestor, including first name, last name, phone number, profile photo, and list of Passengers;
        5. any other information You choose to include in Your Ride Request, such as a list of special instructions for the Passenger[s] and/or Ride;
        6. riding statistics, such as how many Rides You have received.
iii. When Posting a Ride Offer as a Driver

We collect and store all of the additional information that You provide to Us in Your profile. This may include, among other information:

        1. information about Your vehicle, including for example the make, model, year, seating capacity, and insurance coverage;
        2. groups in which You are a member;
        3. driving statistics, such as how many Rides You have given or thanks given to You by Users.
iv. Otherwise through the Site or by telephone, email, postal mail or chat

Users may provide Personal Information on the Services through online communications, groups and payment platforms. Both Registered Users and Site Visitors may choose to provide Us additional Personal Information by phone, email, postal mail, or chat. We collect and store all of the Personal Information You provide Us through these channels. Moreover, if You provide information about someone other than Yourself through any of these channels, You represent that You have authority to do so and consent to Our collection of such information.

b. Information provided by others
i.By Site Visitors, Registered Users and others

Pogo also captures and collects information that Site Visitors, Registered Users and others provide about each other. For example, certain Registered Users may communicate directly with each other through the Services. Site Visitors, Registered Users and others also may provide Us information about other Registered Users and Site Visitors by phone, email or postal mail. Pogo captures and stores all information it receives from Site Visitors, Registered Users and others about other Registered Users and Site Visitors.

ii. By third parties that perform Checks and Monitoring

Pogo may provide some or all Drivers with the option of requesting a background check be run on themselves by a third party consumer reporting agency. Any such background checks will be subject to the terms We establish for such checks on the Site or App pages where You may request them, the terms of this Privacy Policy and Our Terms of Use. Pogo may receive a copy of, or otherwise have access to, any such completed background check. 

In addition, information about driver behavior for Drivers who request such information be recorded about them may be recorded by a third party site called Zendrive (www.zendrive.com) and retained by Pogo. Zendrive collects driving behavior based on GPS and smart phone sensors that are triggered automatically when a Driver starts a ride.

iii. By Facebook if You connect to Pogo through Facebook

If You connect to Pogo through Facebook, either when You register or after You have registered, We will collect, store, and use in accordance with this Privacy Policy any and all information You agreed that Facebook could provide to Pogo through its API. Your agreement (and Our access to Your information) takes place when You instruct, accept or allow Facebook to connect You to Pogo through Facebook. The information Pogo may access, collect and store may include the following, among other information, as allowed by You, Facebook’s API, and Your Facebook privacy settings:

        1. Your name
        2. Your profile picture
        3. Your birthday
        4. the names and pictures of Your Facebook friends
        5. other information You make publicly available via Facebook
iv. By other sources

In addition, We may obtain from other sources publicly available Personal Information, such as demographic data, and other information to enable Us to comply with regulatory requirements, ensure the accuracy of data, better understand Your likely interests, prevent fraud, etc.

c. Information You expressly authorize Us to collect from Your device

We may from time to time request permission for collect Personal Information from or about You that is stored on Your device. For example, if You use a Pogo mobile application, We may request permission to access and store Your location or to access Your contacts. If You grant Your permission, We will access and or store such information unless You subsequently opt out by adjusting the settings in Your mobile device.

d. Technical and usage information
i. Log files, IP addresses and information about Your computer and mobile device

When You visit the Site, Pogo receives the internet protocol (“IP”) address of Your computer (or the proxy server You use to access the internet), Your computer operating system and type of web browser You are using. If You are using Our App on a mobile device, Pogo may also receive Your mobile device id (UDID), or another unique identifier, and mobile operating system. We may correlate this information with other Personal Information We have about You. Additionally, when You visit the Pogo website We and any third parties We use to place ads on Our Site automatically receive the URL of the webpage from which You came. If You click on an ad, We and any such third party may also receive the URL of the page You were on when You clicked the ad and the URL of the site associated with the ad that You clicked.

ii. Cookies and other technologies

We use various technologies to collect information about You, and this may include sending cookies to Your computer or mobile device, among others. Cookies are small data files stored on Your hard drive or in device memory that help Us to improve the Service and Your experience, see which areas and features of the Service are popular, count visits and track User activity, among other things. We may also collect information using web beacons (also known as “tracking pixels”) and digital fingerprinting. Web beacons are electronic images that may be used in the Service or emails and help deliver cookies, count visits, understand usage and campaign effectiveness and determine whether an email has been opened and acted upon. Digital fingerprinting technology enables us to identify the devices that You use to access the Service for purposes such as data analytics, delivering targeted content and advertising, and protecting against possible fraudulent transactions.  The use of cookies, beacons, tags and scripts by us and Our partners, affiliates, tracking utility companies and service providers is covered by Our privacy policy. We have access and control over these cookies. Our partners, affiliates, tracking utility companies and service providers use session ID cookies to make it easier for You to navigate Our Site.  You can remove or block cookies using the settings in Your browser, but in some cases doing so may impact Your ability to use Pogo. Tracking pixels do not identify individual Users and the analysis of data obtained by tracking pixels is performed on an aggregate basis.

Without limiting the foregoing, We use Google Analytics to measure Site usage and improve Our visitor experience. The relevant data is provided to Us by Google in the aggregate (i.e. individual users are not identified) and allows Us to better understand Our Site audience. The Google Analytics features implemented by Us allow Us (i) to evaluate and generate reports on certain demographic, behavioral, and interest metrics of users collected by Google, and (ii) to create advertising remarketing audiences and campaigns based on such metrics, which may be segmented into aggregated groups.

Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Settings form at https://www.google.com/settings/ads.

iii. Social media features and widgets

Our Site includes social media features and widgets, such as the Facebook “Like” button. These features may collect Your IP address, the URL of the page You are visiting on Our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on Our Site. Your interactions with these features are governed by the privacy policy of the company providing the feature.

4. How We Use Information
a. Personal Information

In general, the Personal Information We collect is used to improve Our Services and enhance Your experience with Pogo. For example, We may use Your Personal Information to:

      1. register and service Your account;
      2. include in Ride Requests, Ride Offers, and User profiles;
      3. contact You in response to questions and solicit feedback and input from You;
      4. enable Ride Requestors to provide information about themselves and about Passengers for whom they are coordinating Rides when posting a Ride Request;
      5. enable Drivers to learn about the Ride Requestor and Passengers to evaluate whether to accept a Ride Request;
      6. enable group members to coordinate Rides with members with similar needs;
      7. enable Registered Users who connect to Pogo through Facebook to see which of their Facebook friends who have connected to Pogo through Facebook are Registered Users or friends with other Registered Users who have connected to Pogo through Facebook;
b. Non Personal Information

In general, We use the Non Personal Information We collect to help Us improve Our Services and customize the User experience. We also aggregate the information collected via cookies and similar technologies to use in statistical analysis to help Us track trends, evaluate the effectiveness of Our Services, and analyze patterns in the use of Pogo.

5. How We Share Information

In addition to using the information collected by Pogo for the purposes described above, We may also share Your information with various third parties and other Users and/or Drivers, as described below. Please review Our sharing policy closely, especially with respect to Your Personal Information. By using Our Site or Our Services, You agree to allow Us to share the Personal Information You provide to Us in the ways described below. Your ability to make changes to what information is shared is described below in Section 6.

a. Personal Information
i. With Registered Users

Registered Users who you are not connected to on Pogo, who are not members of Your groups, or who you have not agreed to share a ride with cannot see Your profile or any Personal Information. Registered Users who you are connected to on Pogo, who are members of any one of Your groups, or who you have agreed to share a ride with can see Your profile and profiles of any Minor Passengers connected to your account, including

        1. Your first and last name
        2. first and last name of Your Minor Passengers
        3. Your approximate distance from that user (based on the zip code entered during registration – not a real-time distance between your mobile devices)
        4. Your mobile phone number
        5. the mobile phone number of Your Minor Passengers (optional)
        6. Your profile picture and other pictures You may upload to Your profile during registration, such as pictures of Minor Passengers
        7. Groups in which You are a member
        8. Pogo connections that you share
        9. optional statement about yourself that appears in your profile
        10. special instructions for Minor Passengers
        11. Checks and Monitoring information (optional).

We may display personal testimonials of Registered Users and other endorsements on the Services or in other marking materials. These testimonials or endorsements may include Non-Personal Information such as the Registered User’s first name, first initial of last name, town and state. With a Registered User’s consent, We may include Personal Information such as their full name.

If We terminate Your registration for any reason, We reserve the right to send a notice of Your termination to other Registered Users with whom We believe You have corresponded.

ii. With providers of Checks and Monitoring

We may provide some or all Drivers or Groups with the option of requesting a background check be run by a third party consumer reporting agency. Any such background checks will be subject to the terms We establish for such checks on the Site or App pages where You may request them, the terms of this Privacy Policy and Our Terms of Use. For all Drivers who request background checks on themselves, Pogo will provide such reporting agency with the necessary information to complete such background check, including Personal Information. 

In addition, information about driver behavior for Drivers who request such information be recorded about them is recorded by a third party site called Zendrive (www.zendrive.com) and retained by Pogo. Zendrive collects driving behavior based on GPS and smart phone sensors that are triggered automatically when a Driver starts a ride.  Pogo submits Driver information to Zendrive through the Services in order for Zendrive to record driver behavior in coordination with the Services.

iii. With vendors/service providers

We also share Personal Information with vendors who perform services on behalf of Pogo, including without limitation vendors who provide email services, demographic information, or geo-location information, vendors who process credit card payments, and vendors who send SMS messages to Registered Users’ and/or Passengers’ mobile phone numbers, in each case to the extent applicable. Pogo has selected vendors who maintain high standards with respect to privacy and agree to use the Personal Information only to perform specific services on behalf of Pogo.

iv. With Facebook and Facebook Users if You connect to Pogo through Facebook

If You connect to Pogo through Facebook’s API, You may elect to post certain of Your activities on Pogo back to Your Facebook account. You will be prompted to decide whether or not to share those Pogo activities back to Your Facebook account.

If You connect to Pogo through Facebook, We may allow any of Your Facebook friends who have connected to Pogo through Facebook to see that You are a Registered User. In addition, other Registered Users who have connected to Pogo through Facebook will be able to see if You are friends with any of their Facebook friends or if You share certain affinities or interests with them.

v. As required by law or for reasons of safety

You acknowledge and agree that We may disclose information We’ve collected about You if required to do so by law or if we, in Our sole discretion, believe that disclosure is reasonable to comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law), or to protect or defend Pogo’s, or a third party’s, rights or property. We may also reserve the right to disclose information We’ve collected about You for purposes of protecting the safety of Our community and Registered Users, such as in the case of risk of harm or violence against any person (including You).

vi. With Our affiliates

You acknowledge and agree that to the maximum extent permitted by law We may disclose any of the information We’ve collected about You to any of Our affiliates or subsidiaries, for the purposes of providing You with the Services, operating the Services, and Our other commercial purposes.

vii. With Your Consent

We also may share Your Personal Information with a third party if You consent to the sharing.

b. Non Personal Information

This Privacy Policy does not limit Our use or disclosure of any Non Personal Information, such as information passively collected from Your computer via cookies, web beacons, or standard logging of website activity. If You do not wish to share this information with Pogo, then You should take steps to limit the passive collection of data about Your activities on the Services, for example, by changing Your browser settings to disable cookies. We reserve the right to use and disclose such Non Personal Information, as well as any other Non Personal Information We collect, with Our advertisers and other third parties at Our discretion.

c. Business transactions

In the event We go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of Our assets, Your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of ours or that acquirer’s affiliates may continue to process Your Personal Information as set forth in this Privacy Policy.

6. Your Choices Regarding the Sharing of Your Personal Information

Registered Users have control over optional Personal Information they choose to share with Us when utilizing Our Services (such as certain details in a Ride Request or profile). 

In addition, Registered Users of Our Services who have given Pogo permission to access certain information from their mobile device such as their location or access to their contacts, may subsequently opt out of that information sharing by adjusting the settings in their mobile device.

7. Your Communication Choices

In app, administrative notifications regarding Pogo, including, for example, notices of updates to Our Privacy Policy, notifications regarding Ride Requests, Rides, and notifications from Drivers with whom you have coordinated a Ride are essential to the functioning of Our Services. You may opt out of these notifications via the settings in the app, but this will significantly hamper your experience on Our Services.

Consent to allow Passengers other than You to receive text communications and/or voice calls from Drivers is set on a Ride-by-Ride basis.

8. Changing or Removing Your Personal Information and Closing Your Account

If the Personal Information You provided when You registered changes, You may update this information by logging into Your profile on the Pogo app and accessing Your account settings. If You would like to remove some of the Personal Information You have posted on the Site, such as information You posted in profiles, You may do so by editing or deleting that item in your profile. To request removal of other Personal Information You have voluntarily posted on Our Site, such as information You may have posted in online group forums, contact support@pogorides.com. In some cases, We may not be able to reasonably accommodate Your request to remove Your Personal Information, in which case We will let You know if We are unable to do so and why.

If You no longer wish to participate in Our Services, please contact support@pogorides.com, and We will close Your account.

If We close Your Pogo account, We will remove Your name and other Personal Information from the Services, including information regarding Passengers that is contained in your account. If We close Your account, We have no obligation to retain Your information in our internal databases, and may delete any or all of Your account information without liability. However, We may retain information related to You if We believe it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, Non Personal Information, account recovery, auditing Our records, enforcing Our rights and obligations under Our agreements or if required by law. Pogo may also retain and use Your information if necessary to provide the Services to other Registered Users. For example, just as an email You may send to another person through an email service provider resides in that person’s inbox even after You delete it from Your sent files or close Your account, emails You send to others through Pogo to other Users, as well as Your contributions to Pogo groups, may remain visible to others after You have closed Your account. Similarly, other information You have shared with others, or that others have copied, may also remain visible. Pogo disclaims any liability in relation to the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information.

9. Collection of Information from Children

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. (Please note that COPPA applies only to information received from children and not information that is merely about children.) Pogo’s Site and App are not directed to children under 13 but are instead directed to such children’s parents or guardians for the purpose of coordinating ride sharing. Pogo does not collect personal information about or from individuals under the age of 13 unless such individuals’ parents or guardians give consent pursuant to Our Terms of Service and this Privacy Policy.

If you are a child under 13, please do not attempt to register for the Services.

When You use Pogo to coordinate Rides for Minor Passengers for whom You have the legal authority to contract, We’ll request that you provide Us with certain information that can be used to identify each Minor Passenger, such as name, photo, grade, and phone number (optional). In the event the Minor Passenger is a child under the age of 13, by providing such information about the child, You represent and warrant that you are the child’s parent or guardian and have all requisite authority to provide Us with such information and to authorize Us to use such information. We will then provide the Driver with the Minor Passenger’s full first name, full last name, profile photo, list of parents/guardians, and list of special instructions (if any) for the Minor Passenger in order for the Driver to identify such Minor Passengers for whom You have coordinated a Ride.

Although Drivers with whom You have coordinated a Ride will always receive Your contact number, they will only receive a contact number for any Minor Passengers You have included in the Ride Request if you authorize that information to be shared with them.  If You provide such consent, we will provide the Minor Passengers’ contact number and Drivers will be able to communicate directly with Minor Passengers, including children under the age of 13, over the course of providing a Ride, via voice call and/or text message (if the Minor Passenger has a mobile phone).

If you do not wish other parents using Our Services to be able to voice call and/or text Your Minor Passenger, do not include a mobile number in the profile for that Minor Passenger. You may also contact Us at support@pogorides.com to delete the account of Your Minor Passenger.

In addition, in-person communication between the Minor Passenger and Driver will likely occur at the pick-up and drop-off locations and during the Ride.  By requesting a Ride for the Minor Passenger, You acknowledge that You have consented to such communication.

10. How Long We Keep Your Information
  • Driver Behavior: Pogo does not manage driving behavior, statistics, or analysis on Pogo’s Servers. We use a third party site to process driver behavior called Zendrive (you may contact Zendrive at https://www.zendrive.com for any questions regarding driving statistics and analysis).
  • Pogo Database: To preserve the integrity of Pogo’s databases, standard procedure calls for Us to retain information submitted by members for an indefinite length of time. Pogo understands your submissions as consent to store your information in one place for this indefinite length of time. If required by law, as is the case to comply with COPPA (https://www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/childrens-online-privacy-protection-rule), We will nullify member information by erasing it from the Pogo database. We will also respond to written member requests to support@pogorides.com to delete account information.  We will let You know if We are unable to do so and why.
11. How We Protect Information

We have implemented industry-recognized safeguards to help protect Your information from unauthorized access. These safeguards include:

    1. Pogo uses SSL (Secure Socket Layer), the industry standard method for computers to communicate securely without risk of manipulation or recipient impersonation. We utilize SSL in the online registration process, in the login process, and in the account management section of the Site.
    2. Pogo uses strong encryption technology to protect sensitive information.
    3. Pogo employs firewalls, intrusion detection systems, and system monitoring to protect against unauthorized access of Our systems.
    4. Pogo’s physical infrastructure is hosted and managed within Amazon’s secure data centers and utilizes the Amazon Web Services (AWS) technology stack.

Your user accounts are also protected by the password You use to access Your online account with Pogo, and We urge You to take steps to keep Your password safe. If You feel Your password has been compromised, You should change it immediately by logging into Your account and visiting the Profile and Settings sections. After You have finished using Our Site, You should log out of Your Pogo account and exit Your browser.

WE TAKE THESE PRECAUTIONS IN AN EFFORT TO PROTECT YOUR INFORMATION AGAINST SECURITY BREACHES. HOWEVER, THIS IS NOT A GUARANTEE THAT SUCH INFORMATION MAY NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED BY BREACH OF SUCH FIREWALLS AND SECURE SERVER SOFTWARE. BY USING OUR SITE, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.

12. Links to Other Websites

Pogo may provide links to other web sites that We believe may be of interest to Our users. However, We are not responsible for the privacy practices employed by those web sites, nor are We responsible for the information or content they contain. This Privacy Policy applies solely to information collected by Us through Pogo; thus when You use a link to go from Our web site to another third party web site, this policy is no longer in effect. We encourage Our users to read the privacy policies of these other web sites before proceeding to use them.
